The alleged incident itself happened at the Banbury Court Apartment Complex, Warrenville Hts., Ohio, where, for most of my youth, I grew up, and on the day of this incident, Richard Segines, Sharon Dockery, and myself were out in the apartment complex but not in the same apartment lot where the incident occurred at the Banbury Apartment Complex which has about 18-19 individual apartment courts in it, and each court has about 20 individual apartments inserted.
On the day of this man's death, I had Sharon Dockery drive Richard Segines and myself out to my old neighborhood so I could locate a few old friends. I hadn't been out there in a while and had Sharon sit in the car and wait while Richard and I checked around for a few old faces. Shortly thereafter a gun shot was fired off somewhere in the complex and people began to scatter.
Richard and myself were no different and ran back to the car we came in and hightailed ourselves out of there before the police started coming for obvious reasons, as the three of us were on some form of probation or parole and didn't want to get caught up in the ruckus. Incidentally we weren't the only ones running toward safety. People everywhere where doing the same exact thing... hightailing it out of there.
Per the state of Ohio, "Briscoe and Segines took clothing, a set of keys, the victim's cell phone, and over $200 in cash, and then fled to Dockery's vehicle, pounded on the window, and demanded that she unlock the doors. Dockery testified that she noticed that Segines was holding a gun, t-shirts, and jeans, and that Briscoe was holding a cell phone that was not his. Dockery stated that Segines fought with the man, and Briscoe then jumped in and hit him in the head and the gun discharged.
A resident of the apartment building observed a man being shot and observed two assailants. He then noticed a woman in a gray Ford Escort pulling out. He attempted to warn her to stay out of the area then noticed the two assailants get into her vehicle.
Briscoe ordered Dockery to drive away quickly, and Dockery testified that during the drive, Segines told Briscoe that he thought Briscoe had killed Ali Abu Atiq. Briscoe denied doing so but stated that1 he had obtained about $10 and a cell phone. Segines said he had $200 and a set of keys, he divided the money between him and Briscoe, they threw the keys and phone out of the car window, and Segines changed his shirt.
Dockery noticed a police car behind her, so she parked the vehicle in a driveway of a home in Cleveland, and she and Briscoe pretended to ask for directions. A witness testified that on the day of the shooting, a woman and two men, whom he later identified as Dockery, Segines, and Briscoe, came to his house and asked him for directions. He testified that he saw the handle of a gun inside the car and asked them to leave. Dockery and Segines then left on foot while Briscoe drove off in the vehicle."
